Terms of Service
Introduction
These Terms of Service ("Terms") govern your use of the AXMR web application at www.axmr.app ("Service"), operated by AXMR ("we", "us", "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years of age to use AXMR. By using the Service, you represent that you meet this age requirement. If you are under 18, you confirm that you have the consent of a parent or guardian.
Account Registration
To access AXMR, you must create an account using one of the following methods:
- Email and password
- Google sign-in
- Passwordless email link
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorised access to your account.
Subscriptions and Billing
Plans and Pricing
AXMR offers the following subscription plans:
- Monthly: £9.99 per month
- Yearly: £69.99 per year
Both plans include a 7-day free trial for new subscribers.
Billing
Subscriptions are billed through Stripe. By subscribing, you authorise us to charge your chosen payment method at the applicable rate. Subscription fees are billed in advance on a recurring basis (monthly or yearly, depending on your plan).
Free Trial
New subscribers receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan.
Cancellation
You may cancel your subscription at any time through the subscription management section in Settings, which opens the Stripe Billing Portal. Upon cancellation:
- You retain access to the Service until the end of your current billing period.
- No refunds are provided for partial billing periods.
Plan Changes
You may switch between monthly and yearly plans at any time through the Stripe Billing Portal. Changes take effect at the start of your next billing period.
Price Changes
We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing period after notice is provided.
Use of the Service
Permitted Use
AXMR grants you a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes.
Prohibited Conduct
You may not:
- Copy, redistribute, or publicly perform any audio content from the Service
- Attempt to download, rip, or extract audio files beyond what the Service provides
- Use automated tools (bots, scrapers) to access the Service
- Interfere with or disrupt the Service's infrastructure
- Impersonate another person or create false accounts
- Use the Service for any illegal purpose
- Attempt to gain unauthorised access to other users' data or admin features
- Reverse-engineer or decompile any part of the Service
Content Ownership
Our Content
All audio tracks, branding, design, and other content available through AXMR are owned by us or our licensors. You do not acquire any ownership rights by using the Service.
Your Data
You retain ownership of the data you create through your use of the Service, including your ratings, preferences, and session history. We use this data solely to provide and improve the Service as described in our Privacy Policy.
Health Disclaimer
AXMR provides ASMR audio content for relaxation, sleep, and focus purposes. ASMR is not a medical treatment. The Service is not intended to diagnose, treat, cure, or prevent any medical condition. If you have a sleep disorder or other health concern, consult a qualified healthcare professional.
Service Availability
We strive to keep AXMR available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled or unscheduled maintenance
- Technical issues beyond our control
- Updates and improvements to the Service
We are not liable for any loss or inconvenience caused by service unavailability.
Termination
By You
You may delete your account at any time through the Settings page. Account deletion removes your profile and all associated data from our systems.
By Us
We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service or other users. We will make reasonable efforts to notify you before termination, except where immediate action is necessary.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, AXMR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising from your use of or inability to use the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.
Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when they were last revised. Continued use of AXMR after changes constitutes acceptance of the updated Terms.
If we make material changes, we will make reasonable efforts to notify you (for example, by email or a notice within the app).
